Terms & Conditions of Sale

The Terms and Conditions of Sale are set out in full on the rest of this page. They cover prices, ordering, payment and the dispatch of goods and services. They also describe our commitment to provide goods and services of merchantable quality and to refund your payment if those goods or services are faulty or not what you ordered. They tell you what to do if an item is faulty or doesn't arrive in a reasonable time. They also describe how we protect your personal information and credit card details. The terms do not affect your statutory rights under English law.

Who are we?

Prices

The price is shown against each product or service. That price is valid for orders placed at the time the price is displayed by our webserver at www.genfair.co.uk (but not necessarily by other webservers such as proxy servers). The shipping charge for an order is calculated according to the destination country and the total weight of the order items. The full itemised bill, including the shipping charge, is shown when you complete the order form details (including your delivery address) but before you are committed to purchasing.

Ordering

Please note that, for physical products, there is a minimum order value of £5.00. Orders should be placed using the shopping basket and checkout system provided on this website. Provided you enter your e-mail address correctly in the customer details form, we will e-mail you a confirmation of your order.

Payment

Payments may be made by Access, MasterCard, Maestro, Delta or VISA credit card using the Barclays ePDQ system. In order to enter your credit card details, this website will establish a secure link between your browser and the Barclays secure server. Your card details are held by Barclays. We never see the card details. You should not attempt to send your credit card details by any method other than that provided. If you do so, we will not be liable for any loss. If you consider your credit card number has been fraudulently used you should contact the issuing bank.

Dispatch of goods and services

We will normally arrange for goods to be dispatched within 10 working days of receiving your order, unless a longer period is specified on the relevant pages of our website. Where your order is for a service, the provision of services will take place or start within 10 working days, unless a longer period is specified on the relevant pages of our website. If for any reason an item is unavailable, you will be notified and offered the choice of an alternative item or a refund. Societies providing goods and services under contract to us are run mainly by volunteers. Due to holiday arrangements and for other reasons they will occasionally be unable to meet this timescale. When that applies, a notice varying this provision will be shown on the Contents Page of the relevant supplier on this website. Goods will be dispatched by Royal Mail/Parcelforce, and all items sent overseas will be sent by air mail. Within the UK, First Class post will be used for deliveries up to 2 kg, and over 2 kg dispatch may be by Parcelforce Standard. Results of search services may be sent by e-mail.

Society Membership

Where you apply through GenFair for membership of a Society, our service is limited to submitting the membership application and payment, and is completed when you receive an acceptance into membership from the Society. The acceptance may be in writing or by e-mail. From that time onwards the Society takes over responsibility for the provision of membership services.

Quality of Goods and Services and Returns Procedures

Our aim is to ensure all our customers will be completely satisfied with the quality of the goods and services that they buy from us. If you are not satisfied with the quality of an item, or if an item is faulty or is not what you ordered, please contact us with the details. We will let you know the address to return the item to. When you have returned it we will send a replacement or a refund of your payment, whichever you request.

UK Consumer Protection (Distance Selling) Regulations 2000

In law you have a separate right of cancellation during a "cooling off" period. If you wish to cancel for any reason other than those listed in the previous paragraph, you have seven clear working days to let us know. If you wish to cancel under this provision, please contact us. We will refund your payment on return of the item concerned. The right to cancel does not apply to Birth, Marriage or Death Certificates. We also regret that we cannot accept cancellations of DVDs or CDs once the item has been opened and the seal broken. If your order is for goods, the seven days start when the goods are delivered. We will let you know the address to return the items to. You must return the goods to us at your own expense and take care of the goods before returning them. If your order is for the supply of services (such as a search service) the seven days start as soon as you receive our order confirmation but once we have started to provide the service, you cannot cancel.

Refunds

When we refund a credit card payment, the amount to be refunded will be credited to your credit card account.

Responsibility for Local Taxes and Duties

You are responsible for payment of any Local Taxes and Import Duties levied in the country of the delivery address.

Privacy Policy

We will pass your order and address details (but not your credit card details) to the Supplier who will dispatch the goods or services you are purchasing and not to any other person or organisation. We and all our Suppliers are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the UK Data Protection Act 1998), according to our Privacy Policy.

UK Data Protection Act

If you are joining a Family History Society, your membership details, but not your credit card details, will be passed to that Society. They may be stored in a computer database and used for that Society's mailings and administration purposes and in pursuing its aims according to its Constitution. You may ask the Society to receive a copy of your personal details held by the Society and to have any errors corrected.

Retention of Title

All goods that you order remain our property until you have paid for them in full.

Complaints

Our aim is to ensure you will be completely satisfied with our service and with the goods and servces that we sell. If you have any cause for complaint please contact us.

Applicable Law

These terms and conditions, your order and payment and the delivery of the goods and services you order, form the basis of a contract under the law of England and Wales between you the customer and S&N British Data Archive Ltd. Your statutory rights under the law of England and Wales are not affected by these terms and conditions.
